Did You Miss Me?

Hai everybody.  Tis me, your missing Dean of Fuckery/Law Professor/Queen of the region of mean/resident sarcasm expert.  I just wanted to drop a quick note and thank from the bottom of my cold dead heart Blue, Mama, and Renae for holding the fort while I was gone as well as thanking Schaeffer  for the brilliant and insightful guest blog spots.  I hope to see many more of them.

A huge and heartfelt thank you to Blue for taking care of the kingdom and to Mama and Renae for the incomparable wit and grace holding things together in my absence.  Regularly scheduled programming returns tomorrow and I hope to see all of you here.

As always, guest blogs are welcomed and encouraged.

Schaeffer: Your guest spots were absolutely wonderful and I sincerely mean it when I say I hope to see many more guest spots from you.  Thank you so much for picking up the slack for me.  I truly appreciate the time and effort you put into you writing.

He or she messaged me back and they said they had talked with you and now, they are posting your blogs again. They are good people there, like you! And I am so happy they are going to be spreading the word again when you do your blogs!! They have over 8,000 members and that’s free widespread advertising for you!

    Please don’t lift anything to heavy or try to do too much and tire yourself. Recuperation is always the hard part for me. It seems too slow. If you miss a blog now and then, we’ll understand. But don’t you EVER just disappear on us again! Love you, Kelly!

    Yay…welcome back Miss Kelly! I’m so happy to hear that you’re feeling better, but please take it easy and don’t overdo it. Give yourself time to build your strength back or you will surely have a relapse. I know this because it happened to me when I had the walking double pneumonia a few years ago. Boy that was a hella ride! Two weeks into it and I was wishing for the only relief…death! J/K….but seriously, the recuperation process took time so take ‘er easy for a while, mmmk?

    I was thinking last night (with my trained brain! Lol. Remember that crock of shit that came out of LaVile’s mouth?)…and I think this jury may have already decided on Stabby’s fate. Maybe they just wanted the weekend to sleep on their decision and on Monday morning they’ll take a final vote and come back with DEATH…Stabby’s “ultimate freedom”! Boy that sure would be a sweet start of my week for sure. Then we can all celebrate and Par-Tay!

    LWOP vs DP

    I relish the thought of WOBO hearing the jury sentencing her to death. I would love to see the “I’m winning” smirk fall from her fugly face.

    I have deep concerns that this jury is at a grave disadvantage to render a truly just verdict. They have not been privy to ALL that the guilt phase jury heard and saw. They did not get to see WOBO on the stand for DAYS, WEEKS, smirking, lying, and sparring with Juanderful.

    Which fate will make WOBO suffer the most? Death or LWOP?

    If she is sentenced to death, WOBO will likely not be put to death for 12 + years, if ever? But, DP means she will be incarcerated in a teeny tiny concrete Hell hole, sweltering desert heat, shackled whenever she is allowed to leave that cell for a brief dose of “caged sunshine” and a shower 3 times a week. Soon, all of her creepy minions will forget all about her, visitors will be few and far between, even Mamma Arias will cease to visit….. and she will rot, slowly…. and fade away…. No selling of her amateur “art”, no stubby pencil sketches, No “locks for love”, no “book club”, no “literacy program” and no “recycling program”!!!!! (Those “mitigators” still crack me up!)

    Arizona hasn’t executed a woman since 1930 (Eva Dugan). There have only been 15 women executed in the United States since 1976 when the death penalty was reinstated by the US Supreme Court.

    There are only 2 women on Death row currently in Arizona (Wendi Andriano and Shawna Forde). They are housed in Goodyear, Arizona at Perryville State Prison.

    Debra Milke HAD been on DR for 23 years in Perryville. Sentenced to death in 1990, for her participation in her 4 year old son being shot fatally in the head (she told him they were going to visit Santa). In December of 2014, the Arizona Appeals Court ordered Maricopa County Superior Court judge to dismiss Murder charges citing “Egregious Prosecutorial Misconduct”. Bill Montgomery is still fighting the decision, hoping to appeal, but for now, Milke is free to walk among us, and Double Jeopardy will prevent her from ever being tried again.

    I can’t stand the thought that WOBO could walk free EVER again.

    During Jan Brewer’s 6 year term as the Governor of Arizona, 14 men were executed by lethal injection. (1) African American (1) Latino (1) Native American and (11) Caucasian. All were housed and executed at Florence State Prison in Florence, Arizona. The last to be executed was Joseph Rudolph Wood lll. The execution has been extremely controversial due to it taking nearly two hours for him to die, it should have only taken 10-15 minutes. A newer “cocktail” was used, a lethal combination of Hydromorphone and Midazolam. During the two hours it took for him to die, he was gasping and gulping for air, and convulsing – now, I’m not ashamed to admit, I like the idea of WOBO suffering such a death, as I believe it’s still far more humane than how Travis suffered and died! BUT, the State must adhere to the parameters of the US Constitution prohibiting “cruel and unusual punishment”. The current Governor, Doug Ducey (a Republican Catholic) has not been very vocal publicly about his stance on the DP. But as far as I can tell, the ACLU is still kicking up lots of dust re: the “inhumanity” of the new “cocktail” used in Arizona.

    Facts that I hope the jury is NOT considering….The cost to Arizona taxpayers for DP adjudication and housing is about 7 times higher for DP inmates than LWOP inmates. The average death row inmate is incarcerated for 12-20 years before they’re executed. There are not any really solid numbers that I can find on the exact cost of housing them, but rough numbers suggest it could be as much as $700,000 per inmate for the total of those years. Currently, there are 119 inmates sitting on death row in Arizona, and with that annual estimate, it means that the yearly cost for all of those prisoners would total well over $3.5 million.

    If WOBO is sentenced to death, she will immediately be granted a direct appeal, and then there will then be a series of post verdict appeals all the way up to the Federal level- it’s a loooooong process, and given how “special” WOBO is, she will likely be in court for YEARS! A death sentence also has a greater chance of the verdict being over turned at the Federal level, it happens, Debra Milke is just one example of overturned convictions.

    If WOBO is given LWOP, her “doggy-boy and pony show”, and her NEED for the spotlight and ability to manipulate and control the courts will cease the minute she sets foot on the Perryville express bus! She will still be able to appeal, but only through the Arizona Court of Appeals, then to the Arizona Supreme Court for “Post Conviction Relief”. After that, it’s done and OVER for her. Unfortunately, LWOP at Perryville may no longer mean that she is put in maximum for the first two years! Marissa DeVault (WOBO’s pal in Estrella) was sentenced to LWOP in June of 2014, and she is already in gen-pop with a job! * DeVault’s and WOBO’s cases have MANY common factors- DeVault’s DT also claimed “self defense”, and that she was sexually and physically abused, suffered from PTSD, mental illness, blah, blah, blah! No wonder WOBO and she became such close buds!

    After stating all the above, I will indeed cheer loudly if WOBO is given death, because I know that is what Travis’s family and friends want. And above all else, I want peace for them. But, I will not be crushed if she is given LWOP, because I believe that will still cause her long term suffering. More than anything, WOBO wants attention, and I want her deprived of having center stage.

    WOBO will have many a Badyear in Goodyear, regardless of which sentence is rendered.

      I totally concur! The Oklahoma execution of Clayton Lockett was botched, with Lockett dying of a heart attack about 40 minutes after the execution began. Charles Warner, who was scheduled to be executed two hours later, was granted a stay.

      An independent pathologist in Texas will perform an autopsy as part of an investigation into the botched execution. The autopsy is expected to take 8-12 weeks, and no other executions are likely to take place in Oklahoma until the investigation is complete. (The Oklahoman, 5/2/14). As a result, there is a moratorium on executions in OK. The Florida Sup. Ct. stayed pending executions in 2015 because of U.S. Sup. Ct. review of Okla. lethal injections. I’ve red recently that they expect a decision in June, 2015 when executions will (perhaps) resume.

      The issue is that the medications that have previously been used come from Europe, where no death penalty exists, and manufacturers are refusing to ship the medication to prisons. As a result, the prisons have gone to new medications. In Ohio, the execution of Dennis Mcaguire was botched, an investigation is pending…and the dose of midazolam will be raised from 10 mg to 50 mg, and the dose of hydromorphone will be raised from 40 mg to 50 mg. California, as you said, hasn’t had an execution in YEARS, and as a result has a stockpile of sodium thiopental which was obtained from Great Britain, but can no longer be used. (I believe it’s “expired?”) California currently has a moratorium of executions-one case in appeal could affect all, based on “unconstitutional based on arbitrariness”. Colorado Gov. Placed “indefinite stay” on executions, N.Carolina:injection issues, Arkansas and Kentucky- deFacto moratorium based on unconstitutionality and better protocol, Washington-Gov called for moratorium for remainder of his term, Pennsylvania-moratorium for study and no drugs, Oregon new Gov continuing moratorium in place by old Gov., New Mexico & Conn-abolished,
      Nevada, Tennessee, Nebraska, Indiana-don’t have drugs, Montana-challenged, Ohio, Alabama, Louisiana – under review and all Federal executions are under review.

      I think that many of us aren’t aware that the Death Penalty is such a big issue at this time!

      I don’t care if she’s never put to death…I just think that she deserves “ultra confinement”!

        You do know that ‘expired’ drugs are not always bad? At some drug companies, when the ‘expired’ drugs are returned, they are just re-packaged with a new ‘expiration date’. Depends on the drug. Too bad Calif doesn’t realize the drugs are probably good. They could sell them to other states that want them.
        There is also a vet version that is well available.
        On the other hand, the states could just give ‘straight’ doses (high) of potassium chloride (after the Versed) and it would kill someone quite instantly so no need for the pentothal. I would think the Versed (midazolam) would not allow the condemned to feel the pain of the massive heart shock.

        I want her to get Death. I don’t want her to drag appeals on & on (like she will) & I don’t want AZ to pay anymore for her! But, I won’t be mad at lwop. I just want her to be miserable, in a cage, all alone, & away from others.I want her driven insane.She doesn’t deserve to be comfortable. Im for whatever gets her closest to all of that.
        I hope she goes away after this phase. Her “friends” that she’s never even met or spoken to,will fade away. The chump change they’ve donated will dry up.
        Maybe we need to use firing squads instead. These killers didn’t care what pain they caused their victims! They should be thankful, that the gov’t is forced to care about what they go through during the injection! Sadly, I don’t.

        p.s. Im in Ca & we could use the money…. I say sell the expired drugs! Besides, its the least we could do since AZ is having to foot her bill.

        *Renae- I take expired drugs if I need to. We had an older Pharmacist in the family. He didn’t believe in expiration dates.lol Sometimes, I do buy antibiotics at the “feed store”. Ive looked them up before & the #’s on them come up as human! Lol Desperate times,,,,, ;)haha

        Darlin, you aren’t the only one! I have one drug, that if I need, would cost 100’s of dollars in a ‘people Rx” …but in vet med, it is under$40. Well, I only need it maybe once in 10 years but when I do, I use the stuff from the vet. I know the manufacture of it is as pure as a lot of the drug companies, and better in some cases.
        When I lived out West, I used to just ‘pop down’ to Tijuana and pick up stuff there. I think half of the seniors in Southern California do as well. Even Canadian drugs are only about a third the cost of those in the States, so I coordinate my American Doc and Canadian Doc.

        I wish I could do that! Have any idea what my KADIAN costs? And the docs would GIVE me the RX I NEED…but because Walgreens was FINED 80 MILLION in penalties for THEIR carelessness with THAT drug…no pharmacy will carry the drug! (AND if the did, it would be close to $1200 a month) ASSININE!

        Have you checked out Missouri? While most states are delaying and delaying, Missouri just keeps chugging right along, they are not hesitating to execute. They also have still have the legal option to use gas instead of lethal injection, so if the drugs try to stop them, they’ll just use the gas. I’ve also heard of calls for “hook up old sparky again”. Electrocution was the execution of choice for a long time. Don’t be murdering anyone in Missouri! It may take awhile but they WILL get you.

        Good to know I’m not the only one. The price for these drugs at such a store is SO cheap!I have gone to Mexico for my prescriptions. I thought about it in Canada. But I was unsure of the who,what,where. While, in Mexico, they just walk you in to stroll the shelves. They brought out the big pharmaceutical book for me to look through.lol I have ordered Retin-A from Canada in the mail. The only stipulation is, if it gets picked up in the mail. There’s no refunds. Mine made it.
        * My DDS tried to tell me that animal drugs had fillers. Until I told him I looked them up. He wasn’t amused.lol I had an infection,damnit.lol Those damn desperate times.lol
        **Im watching a HBO documentary today on Robert Durst. I taped it. It’s a 5 part mini doc. Each one is around 30-45 mins ea. Pretty crazy stuff.

    This case has been disturbing in many, many ways. The savage way Travis’ life was taken is never far from my mind. You know when I step back and really take an objective look at this trial, one thing becomes crystal clear–there is a need in this country to have an honest and informed conversation about some very important things–1) The CJ System and victims being put on trial by those who perpetrated the crime, 2) How do we as a nation objectively confront the exploitation/abuse of DV as a defense for murder, 3) Forensically categorizing cluster B PD’s as something other than Mental Illness, especially APD, NPD and BPD, 4) does the Constitutional right of a defendant to a fair trial mean at ANY AND ALL costs, and 5) how do we reclaim balance (reason and sanity) in the CJ system that is bombarded with political correctness.

    It never ceases to baffle me how many people really don’t understand the difference between thought disorders and personality disorders. Perhaps it is because her crime was so heinous to the general public that we want to believe that there is something medically wrong with a person who commits an act like Jodi did. The general public wants an explanation and one that includes more than the simple fact that Jodi is a “bad” person. It is uncommon that we see a female as a true psychopath, but they do exist, and we are seeing it in Jodi Arias. She has a severe cluster B personality disorder. What does surprise me is that other than getting smacked a few times by her parents, and again these are her claims, there is not the psychosocial history that one might expect to find in severe personality disorder, such as extreme childhood sexual abuse or other kind of significant life threatening trauma. I am not buying the PTSD business with her either. She just does not fit the criteria, and I don’t think the jury is buying it either.

    I was so grateful when juror #12 was dismissed on Monday and believe we all dodged a bullet. During voir dire he had stated that the death penalty was for serial killers! OMG! That is exactly one of the many outrageous things that former foreman Z announced during his whirlwind media tour less than 24 hrs after he directly caused the mistrial.

    How in the heck can *anyone* be considered death qualified with such a response? I’ve often thought, if JA hadn’t been arrested that day that she may have had other victims in mind and could have become a serial killer. How could they have put #12 on this jury knowing that he would never be willing to vote for death? I find that infuriating.

      Back in the day…every work day started and ended with a bumper to bumper drive thru “the Orange Crush”…oh, Lordy, how I hated that! A 16 mile drive would take me between 45 to 90 minutes. I was slowly growing old in the fast lane! One day, I was so frustrated that I told Son “be sure to see what’s going on up ahead, this traffic deserves at least 3 dead bodies!” (I was very stressed with work AND traffic!). (No, no bodies on that trip)

      My point here is that humans, by nature are curious…that work for us (inventions, better quality of life) and against us (rubbernecking to see nothing & backing up traffic for miles). Our curiosity also wants to understand “different”..we want to be able to say arias is bad, sic, evil, mental, or whatever. We are also pretty forgiving, once we understand! And IF SHE IS MENTAL, WHY? Did her mother drink or do drugs during pregnancy, causing fetal alcohol syndrome? Does she suffer some genetic chemical disorder? (I’m not buying the wooden spoon excuse…how many of us would have dead husbands if getting a spanking as a child were a logical excuse for killing somebody who didn’t do what we wanted them to do?) “I SWEAR, your Honor, my daddy spanked me when I was young, and when my husband refused to buy me those diamond earrings I wanted, my disorder kicked in, and I had to kill him…but, you know, it really wasn’t MY fault! I just couldn’t help myself…and I promise I won’t do it again…until next time that someone pisses me off…really! I’m safe!). You just can’t walk around killing people because you can’t control them!

      As far as juror 12…the defense wanted him there! And in my mind…IF arias had been much of a planner-instead of do disorganized…she wouldn’t have been caught…and if she hadn’t been caught…I believe her brain is do disordered, she would have felt JUSTIFIED a in killing again!

    Glad you’re on the mend Kelly. Guest bloggers were awesome. Totally ready for sfs. Bought a new coffee cup with a lid. Smart as all my sweaters have coffee stains from laughing. Maybe I should buy depends, hmmm. I’m trying to drink tons of water like a good girl should, but am worried about laughing my ass off. Feel good and stay warm. We are having a heat wave. It was above 0 this morning and is 27 now. I’m taking the dogs out without a jacket

      Hai Lori. Thank you. Yes there are amazingly talented and caring people on this blog. I’m researching what I want to write about tonight and it has led me in an entirely different direction. Even I don’t know what might come out of my mouth at this point. And just for a little weirdness the Chicago song 25 or 6 to 4 has been on loop in my head since deliberations started. I don’t know what it means but I’m linking it anyway. You all figure out what it means and let me know.

    The first definition cited comes from the State v. Velazquez case:

    “Cruelty involves the infliction of physical pain and/or mental anguish on a victim before death. A crime is committed in an especially cruel manner when a defendant either intended to inflict mental anguish or physical pain upon the victim, or reasonably foresaw that there was a substantial likelihood that the manner in which the crime was committed would cause the victim to experience mental anguish and/or physical pain before death.”

    “The victim must be conscious for at least some portion of the time when the pain and/or anguish was inflicted.”

    Second- the trial court defined “especially cruel” as follows:

    “In order to find that the especially cruel aggravating circumstance is present as to either murder, you must find that the State has proven beyond a reasonable doubt that the murder was especially cruel due to the infliction of either extreme physical pain or extreme mental anguish upon the victim.”

    I say it is ESPECIALLY CRUEL!

    I think it is important to note that we all want Stabby in a concrete prison cell . That is where she is going regardless. I believe in isolation she will lose what is left of her mind. I have said it before. Perryville is the big girl prison and the princess is in for a rude awakening. Welcome back Kelly. You were missed.
